These Terms govern voluntary submissions to The Archives. Please read them before consenting. “ALSO AND PERHAPS” refers to the business operating The Archives and, where applicable, its owners and permitted successors.

1. Eligibility and authority

You must be at least 18 years old. You represent and warrant that you are authorized to submit the story, text, photograph, image, name or other content (collectively, “Submission”) and to grant the rights below. You will not submit material on behalf of a minor or another person without appropriate authority.

2. Ownership; extensive commercial license

You retain the copyright and ownership rights you actually hold in your Submission. In exchange for the opportunity to submit material for consideration (which does not guarantee publication), you grant ALSO AND PERHAPS and its owners, affiliates, successors, assigns, licensees, service providers and authorized commercial partners a non-exclusive, worldwide, royalty-free, fully paid, transferable and sublicensable license to host, store, copy, reproduce, modify, adapt, excerpt, translate, anonymize, combine with other content, create derivative works from, publicly display, distribute, publish, advertise, market, sell and otherwise exploit your Submission, in any media or format now known or later developed, for purposes connected with the brand and its business. These uses expressly include The Archives, websites, email, social media, editorial projects, campaigns, lookbooks, paid advertisements, events, collaborations, retail displays, clothing and streetwear designs, embroidery, prints, accessories, merchandise, packaging, product labels and other products offered for sale, without additional consent, approval, royalties, revenue sharing or other compensation. The license may be exercised directly or through manufacturers, contractors, agencies, retailers, distributors and commercial partners acting for or with ALSO AND PERHAPS. This license begins when your Submission is received and, subject to the withdrawal provisions below and nonwaivable law, continues for the duration of applicable rights for uses already released or committed to production.

3. Consent to editing, association and attribution

ALSO AND PERHAPS may choose, edit, shorten, rearrange, format or adapt your Submission to fit creative, editorial, commercial or technical requirements, without consulting you, provided it does not knowingly present your words as a materially false product endorsement or otherwise violate applicable law. We may elect not to use your Submission or stop using it at any time. We will honor the public credit selection you make in the form (anonymous, initials or first name) for Archive attribution; an anonymous selection does not permit us to disclose your private submission email as public attribution. Where you supply your own identifiable image, name or likeness, you grant consent to its inclusion in the uses described here to the extent you have authority to do so. We do not promise a byline, tag, credit, notice, final approval, product sample, payment or notice before each use.

4. Rights clearance and content promises

You represent and warrant that: (a) the Submission is original to you or you possess all necessary licenses, releases and permissions for the authorized uses; (b) your Submission and our authorized use will not infringe copyright, trademark, privacy, publicity, confidentiality or other third-party rights; (c) each identifiable person appearing in an image or other content has given the necessary authorization for commercial use, including on merchandise and in advertising, and you can provide evidence of that permission upon request; (d) it does not contain unlawful, defamatory, threatening, sexually exploitative, harassing, deceptive or otherwise prohibited material; and (e) any factual statements you present as facts are made in good faith. Do not send confidential information, private addresses, financial information, sensitive identifying details, or material you are not comfortable potentially being made public. We may seek further documentation or separate model/property releases and may withhold or decline use until they are supplied.

5. No obligation; no compensation

Submitting a story or photograph does not create employment, a partnership, an agency relationship, a paid commission, a contest entry or any obligation to compensate you. We have sole editorial and commercial discretion over selection, timing, presentation, placement, product development and discontinuation, subject to law. We may receive revenue from products, partnerships or campaigns featuring or inspired by your Submission, and you have no entitlement to revenue, royalties, accounting, profit participation or product approvals.

6. Withdrawal and already-committed uses

You may request withdrawal of your Submission before it is first published or incorporated into commercial production by emailing alsoandperhapsla@gmail.com with enough information to identify it. We will make reasonable efforts to process such requests before first use. Once a Submission has been published, sent to a manufacturer, incorporated into production or distributed, removal may not be feasible. Requests do not retroactively revoke rights already exercised, require recall or destruction of manufactured inventory or printed materials, or require removal of third-party reposts, historic records or reasonably necessary legal/compliance copies, to the extent permitted by law. We may consider later removal requests on a case-by-case basis, and applicable privacy rights remain unaffected.

7. Third-party claims; indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless ALSO AND PERHAPS, its owners, affiliates, successors, contractors and authorized partners from third-party claims, liabilities, losses, damages and reasonable legal expenses resulting from a material breach of your representations, warranties or obligations under these Terms. This does not apply to the extent a claim results from our own unlawful conduct, willful misconduct or other liability that cannot lawfully be shifted.

8. Privacy and personal information

We may collect your Submission, chosen attribution, optional email, consent version and timestamp, receipt identifier, and technical security data to receive, evaluate, moderate, preserve and document submissions, respond to requests, and protect the service. Shopify and contracted hosting, database, storage, anti-abuse, and security providers (which may include Render, Supabase and Cloudflare) may process data on our behalf to operate these features. These providers may process connection information as part of delivering the services. Photographs and unapproved stories are intended to remain private until selected and authorized for use. Your optional email is for submission-related contact and is not, by itself, consent to marketing emails or texts. We retain records for as long as reasonably needed for editorial operations, rights documentation, security, and legal obligations, subject to applicable deletion rights. You may contact us to exercise applicable rights to access, correct or delete personal information. Our Privacy Policy governs personal data processing, including statutory privacy rights. Publishing a story or image can result in copies or references outside our control.

9. Moderation and availability

We may reject, hide, remove, suspend or discontinue any Submission or feature, and may investigate rights or safety complaints without notice, except where law requires otherwise. We do not promise continuous website availability, permanent hosting, preservation of submitted files, publication or any particular editorial treatment.

10. Reasonable limitations; rights preserved

To the maximum extent allowed by applicable law, ALSO AND PERHAPS disclaims liability for indirect, incidental, special or consequential loss arising solely from participation in The Archives. Nothing in these Terms excludes or limits liability for fraud, willful injury, violations of law or any other liability that may not legally be excluded, nor does it restrict nonwaivable consumer or privacy rights. If a term is held unenforceable, the remainder remains in effect to the extent permitted.

11. Governing law and changes

These Terms are governed by California law, except where mandatory law requires otherwise. Any dispute will be handled in a court having appropriate jurisdiction, subject to applicable law. We may revise these Terms prospectively. The consent version in effect when a Submission is received will be recorded with that Submission; later revisions will not automatically expand an existing contributor’s grant without the required agreement.
